What the USDA just did

The USDA accelerated finalization of 12 new product category designations under the BioPreferred program. Each designation establishes a minimum bio-based content requirement and creates a federal procurement preference for qualifying products.

The timing wasn't coincidental. The Strait of Hormuz closure in March 2026 demonstrated that petroleum-dependent supply chains are strategically vulnerable. The USDA's category expansion had been in development through the regular rulemaking process, but the petroleum crisis provided the political momentum to finalize.

For federal buyers, the practical impact is clear: the list of product categories where bio-based procurement is the default just got longer. If you're buying above $10,000 in any of these categories, BioPreferred compliance is now part of your acquisition planning.

The compliance framework

The statutory foundation comes from the Farm Bill, codified at 7 U.S.C. 8102. Federal agencies must procure bio-based products within designated categories unless they determine that qualifying products are not reasonably available, fail to meet performance requirements, or are not available at a reasonable price.

That 'unless' clause matters. It requires documentation. A contracting officer who bypasses a bio-based alternative needs to justify the decision in writing — not just assume conventional products are acceptable. The burden of proof is on the agency, not the supplier.

FAR 23.103 operationalizes this requirement. It directs agencies to give preference to bio-based products and requires that procurement personnel consider bio-based alternatives during acquisition planning. The FAR clause 52.223-1 requires contractors to certify the bio-based content of products they deliver under federal contracts.

What to do right now

Start with your existing contracts. Identify line items in the 12 newly designated categories. For each one, check whether your current supplier offers a bio-based alternative that meets the USDA minimum content threshold.

If you're a manufacturer, this is your signal to get certified. The USDA BioPreferred label requires third-party verification of bio-based content. Products with the label are immediately eligible for the federal procurement preference. Products without it aren't disqualified, but they're at a significant disadvantage.

If you're a federal buyer, update your acquisition planning checklists. Add a bio-based availability check for every purchase above $10,000 in designated categories. Document your findings either way — compliance is about demonstrating that you considered bio-based alternatives, not that you always chose them.
